The Constitutional Court has annulled the law on the containment of rents of housing rent, which the Parliament of Catalonia approved in September 2020, because it invades powers that are of the Spanish state.
It was a sentence that was already foreseen, and that from the professional sector we had already warned it. This limitation of rental prices would only cause legal uncertainty and reduce the supply of rental flats.
It should be remembered that this income containment regulation only affected populations over 20,000 inhabitants
From now on, rental prices are already liberalized, respecting, as is logical the Law of Urban Leases, which already provides for protection for tenants.
The ruling does not affect rental contracts signed before this cancellation, which will be maintained in the same terms, and will have effects only for contracts signed from now on.
