Essential procedures during the purchase and sale of a home

When you reach the negotiation phase and the corresponding closing of the operation, you will need to take care of carrying out the following procedures:

  • Check the status of charges and ownership of the property in the Property Registry.
  • Find out the mortgage situation with the financial institution.
  • Check the status of the charges: the payment of taxes (IBI) and fees with the City Council, the community of owners and possible urban or administrative impacts.
  • Process and provide the necessary documentation required for the purchase and sale, such as the habitability certificate, the energy efficiency certificate, IBI receipts and the latest utility receipts.
  • Writing, adaptation to current regulations and signing of the corresponding legal documents (deposit contract, private purchase contract, etc.).
  • Contact with the financial institution to provide them with all the necessary documentation.
  • Management of possible cancellations of charges such as mortgages, seizures and resolutory conditions.
  • Registration of ownership: inheritances and usufructs.
  • Corrections at the land registry office.
  • Processing the NIE for non-residents.
  • Preparation of the file and accompaniment of both parties at the notary’s office for the signing of the public deed of sale.

Essential procedures after the sale

The sale of a home does not end with the signing of the deed. Otherwise, the operation must be closed with some pending procedures.

  • Registration of the public deed in the Property Registry.
  • Settlement of the tax on Patrimonial Transmissions, Documented Legal Acts and IRPF withholding procedures for non-residents.
  • Settlement of the municipal capital gains tax at the City Council.
  • Registration and change of ownership at the Cadastre office.
  • Management with supply companies for registrations and changes of ownership of meters.
